Attorney General Submits Annual Report for FY 2079/80 to President Paudel
Kathmandu, Jan 22: Attorney General Dr. Dinmani Pokharel has presented the annual report for the financial year 2079/80 to President Ramchandra Paudel. The submission took place during a special ceremony at the President’s Office, Sheetal Niwas.
As per Article 159 of the Constitution of Nepal, the annual report of the Attorney General’s Office must be submitted to the President.
The report states that out of the total cases, writs, and petitions argued and defended in the Supreme Court by the Attorney General’s Office, 14,289 cases were presented, and 2,914 cases were rejected. The government’s success rate in these cases was 41.28 percent.
In cases defended by the High Public Prosecutor’s Office, out of 17,412 cases, the success rate for those dismissed was 53.58 percent.
For the Special Public Prosecutor’s Office in Kathmandu, out of 10,023 cases defended, five out of 12 cases were dismissed, resulting in an 83.68 percent success rate.
The district public prosecutor’s office defended 36,703 cases, achieving a 76.84 percent success rate in cases that were dismissed. The overall success rate for pro-government cases in writs and petitions was 69.19 percent.
The total number of cases, writs, and petitions argued and defended by the Attorney General’s Office and subordinate public prosecutor’s offices was 125,830, marking a 13.32 percent increase from the previous year.
The report highlights that the number of cases defended by the Public Prosecutor’s Office on behalf of the government in cases filed as government advocates or defendants was 107,908.
The total number of writs submitted to the Government of Nepal was 13,541, and the number of other petitions was 4,381. The report notes a 39.60 percent increase in the number of cases, writs, and petitions represented and defended by government lawyers over the past five years.
In the last year, the decision to prosecute in favor of the government was made in 38,900 cases, with 63,121 defendants. Among these, 32,567 cases fell under Schedule 1 of the Civil Criminal Procedure Code, 2074, with 54,959 defendants.
