Indian Supreme Court justice asked to resign over rape remarks

Kathmandu, March 4. Feminists and rights’ activists in India have sent an open letter and demanded the resignation of chief justice Sharad Bobde.
Justice Bobde had given certain remarks for a rape case that has sparked an outrage. He asked the culprit who is accused of stalking, tying up and raping a minor along with other allegations to marry the victim.
He also questioned, “Could sex between a married couple considered as rape?”
His second statement came for a case of a couple in a live-in relationship where the woman had filed the case on the man for rape.
The activists have said that Chief Justice’s statements “will send a message to the rapists that marriage is a licence to rape; and that by obtaining such a licence, the rapist can post facto decriminalise and legalise his act”
India is amongst the three dozen countries that have failed to criminalize marital rape despite recommendations from the United Nations (UN). The campaigners have said that the statements given by the chief justice is extremely problematic and sends out such messages to other institutions.
Chief Justice Bobde is yet to react on the issue.
