Writs against appointment of Gautam to the Upper House
Kathmandu. Senior advocates Dinesh Tripathi and Badri Raj Bhatta have filed writ petitions separately against the appointment of Nepal Communist Party Vice Chair Bam Dev Gautam as a member of the Upper House.
Both advocates have claimed the appointment as being against the norm of the constitution and have demanded to repeal the decision. Gautam had been appointed to the Upper House on Thursday by President Bidya Devi Bhandari on the recommendation of the government after the then Finance Minister Yuba Raj Khatiwada’s term ended on March 3.
Senior advocate Tripathi claimed that preparations were being made to make Bam Dev Gautam a minister which is against the constitutional provision.
“I have demanded interim order to revoke the recommendation by the cabinet to appoint him, prohibitory order to stop him from becoming minister and mandamus to issue standards for appointment in the National Assembly,” Tripathi told.
Advocate Bhatta has also made a similar demand. As per sources, their petitions have been registered today and the hearing is scheduled for Wednesday. The Office of the President, Office of the Prime Minister and Council of Ministers and Nepal Communist Party (NCP) have been made defendants in both the writs.
