SC prohibits Bam Dev from assuming additional constitutional roles
Kathmandu. The Supreme Court (SC) has issued an interim order forbidding extra constitutional responsibilities to the newly appointed National Assembly member and Nepal Communist Party (NCP) vice chair Bam Dev Gautam.
While there were rumors about Gautam being appointed a minister, this step from the SC has certainly dampened the spirits. A single bench of Justice Aanand Mohan Bhattarai issued an interim order on Wednesday, responding to a writ petition filed by senior advocate Dinesh Tripathi who claimed that preparations were being made to make Bam Dev Gautam a minister which is against the constitutional provision.
Constitutional experts opine that the practice of appointing politicians defeated in the parliamentary elections to the Upper House is setting a wrong precedent.
The Supreme Court has summoned both sides for a discussion over the issue on September 30.
Gautam was appointed to the Upper House on September 14. He had been defeated in the last parliamentary elections from Bardiya-1.
