Judges hold different opinions on Gautam’s case
Kathmandu. The refusal of the interim order in the petition filed against the appointment of NCP Vice-chair Bam Dev Gautam as member of the National Assembly had not been a unanimous decision.There had been differing views among the judges, which came to light after the written order was made public on Thursday.
The constitutional bench consisting of Chief Justice Cholendra Shumsher JB Rana, Justices Dipak Kumar Karki, Hari Krishna Karki, Bishwombhar Prasad Shrestha and Ishwori Prasad Khatiwada on Wednesday had issued the order that reversed the previous interim order and made leader Gautam eligible to take constitutional responsibility.
In the order, CJ Rana, Justices Dipak Kumar Karki, Hari Krishna Karki and Bishwombhar Prasad Shrestha agreed to allow constitution responsibility to leader Gautam while Justice Khatiwada had a different opinion. Justice Khatiwada argued that leader Gautam could not be considered qualified for the National Assembly as he was defeated in the election to House of Representative from Bardiya.
Despite Khatiwada’s argument, the verdict, which allowed Gautam to take up the responsibility as National Assembly member, was reached accepting the argument of the majority, including CJ Rana.
